Spain to file suit against Baxter over dialysis deaths

MADRID (Reuters) – Spain is to seek legal action against Baxter International Inc in the United States in connection with the deaths of 11 Spanish kidney patients who used the firm's products, the health minister said on Wednesday.

Celia Villalobos said the suit would seek to show that Baxter had breached the terms of its contract. "It is decided. [The suit] will be in the United States, for breach of contract, and in principle for a considerable sum of money,'' Villalobos told the Senate.

The US healthcare firm has acknowledged that a fluid used in Baxter filters, or dialyzers, to treat kidney dialysis patients may have played a role in the deaths of 51 people worldwide.

A Spanish Health Ministry study earlier this month found a clear link between the deaths of 11 kidney patients in Spain and the use of Baxter's dialyzer.

Health officials in the United States are also investigating deaths linked to Baxter kidney dialysis filters in Germany, Croatia, Italy, Colombia, Taiwan and two US states, Texas and Nebraska.

Stock market analysts are confident that Baxter has set aside enough cash to cover litigation costs related to the deaths.
