Court Orders South Africa to Provide Nevirapine

South Africa’s highest court ordered the government on Friday to stop blocking the universal provision at public hospitals of nevirapine, a drug shown to help prevent vertical HIV transmission.

The Constitutional Court’s decision removes the last obstacle put up by the government to the use of the drug, which some officials have said could be more dangerous than the disease itself. It was a victory for AIDS lobbyists, including the Treatment Action Campaign (TAC), whose supporters in the court cheered and applauded the ruling. Activists, many of them with buttons or T-shirts proclaiming their HIV-positive status, danced outside the court.

“This is more than we hoped for,” one activist told reporters. Chief Justice Arthur Chaskalson said the government’s restriction of the drug to 18 pilot sites around the country fell short of its constitutional obligation to offer the best treatment available.
